1. Service description

Pouchlinks is a file sharing service operated by Software Hive GmbH. The service allows users to upload and share files via generated links.

2. Scope of Service

The service enables:

• Uploading and temporary storage of files
• Sharing access via unique links
• Optional security features such as password protection and end-to-end encryption

The service is provided on an "as is" and "as available" basis.

3. User Responsibilities

Users are solely responsible for the content they upload and share.

Users must not:

• Upload or distribute illegal content
• Violate intellectual property rights
• Distribute malware or harmful software
• Use the service for abusive, fraudulent, or unlawful purposes

Users must ensure that they have all necessary rights to the content they upload.

4. Content Ownership

Users retain ownership of their content.

By using the service, users grant the operator a limited right to store and process the content solely for the purpose of providing the service.

5. Availability

We do not guarantee uninterrupted availability of the service.

Maintenance, technical issues, or external factors may result in temporary interruptions.

6. Data Retention and Deletion

Files are stored temporarily and are automatically deleted after the selected expiry period.

Deleted content may remain in backup systems for a limited time for technical reasons.

7. Security and Encryption

The service provides secure transmission via HTTPS.

Optional end-to-end encryption may be available. If enabled:

• Only users with the decryption key can access the content
• The service provider does not have access to encrypted content

Users are responsible for safeguarding access links and encryption keys.

8. Limitation of Liability

To the extent permitted by applicable law, the service provider shall not be liable for:

• Loss of data
• Unauthorized access to shared links
• Misuse of shared content by third parties
• Service interruptions

9. Takedown and Abuse Handling

We reserve the right to:

• Disable access to any content reported as unlawful or abusive
• Suspend or restrict user access
• Remove content without prior notice where necessary

10. Law Enforcement and Legal Requests

We may cooperate with law enforcement authorities and comply with legally binding requests.

This may include:

• Providing available account or usage information
• Disabling access to content
• Preserving data where required by law

We do not provide access to encrypted content where end-to-end encryption is enabled and the decryption key is not available to us.

11. Governing Law

These Terms shall be governed by the laws of Switzerland, unless otherwise required by applicable law.

12. Changes to Terms

We reserve the right to update these Terms at any time.

Continued use of the service constitutes acceptance of the updated Terms.
